Thank you for joining us for a Puppy Play Date.
Hawaii Goldens Beach Play Date Waiver and Release of Liability IMPORTANT – PLEASE READ CAREFULLY BEFORE PARTICIPATING This Waiver and Release of Liability (the “Agreement”) is entered into by and between the undersigned Participant (the “Participant”) and Hawaii Goldens® , a business operating in the State of Hawaii, in connection with voluntary participation in the Hawaii Goldens Play Date(s) (the “Event”). By signing this document, I acknowledge and agree to the following terms:
I acknowledge that my participation in the Event is entirely voluntary and not required as part of any service or contract with Hawaii Goldens.
I understand that the Event takes place in a public setting (e.g., a beach), which involves inherent and unpredictable risks, including but not limited to: Injuries to myself, my guests, or my dog(s) Injuries or harm caused by other animals or participants Damage to my personal property, including vehicles, leashes, or equipment Hazards inherent in the natural environment (e.g., waves, debris, sand, heat, insects) Dog fights or animal aggression Illness or disease transmission between dogs or humans I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation.
To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Hawaii Goldens® , its owners, agents, volunteers, representatives, employees, or contractors (collectively, the “Released Parties”) for any and all liability, claims, demands, causes of action, or damages arising out of or related to any loss, damage, injury (including death), or other incident that may occur to me, my guests, or my dog(s) in connection with or during the Event, whether caused by negligence or otherwise.
I certify that my dog is non-aggressive, in good health, up-to-date on vaccinations, and under my control at all times. I understand that I am solely responsible for supervising, controlling, and cleaning up after my dog at the Event.
I agree to indemnify, defend, and hold harmless the parties from any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: Any act or omission by me or my dog(s) Injury or damage caused by my dog(s) to another person, dog, or property My failure to comply with any applicable laws, rules, or regulations
In the event of an injury to myself or my dog(s), I am solely responsible for any required medical or veterinary treatment and agree to bear all associated costs.
I grant Hawaii Goldens permission to take and use photographs, videos, or other recordings of the Event that may include myself or my dog(s) for promotional purposes without compensation.
This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaii.
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.
