Pick of the Litter for Stud Service — please complete the form below.
Stud Owner will sign AKC/APR or other litter registration when the owner of the female applies for litter with the sire owned by the Stud Owner.
The dam owner will not allow the female to be bred by another male than the one listed in this contract.
The Breeder / Stud Owner / Company and its owner has the right to pick a puppy after viewing the entire litter. The dam owner will not hide any of the puppies born as a result of the matings from the Stud Owner. the Stud Owner will be allowed to pick out of all the puppies which one to take as payment for the stud service. the Stud Owner WILL NOT BE FORCED to pick from the litter sooner than 6 weeks from the date of whelping. A fine of $1,000 per live puppy will be assessed to the female owner if it is found that the female owner has attempted to hide any puppies from the stud owner. This fee must be paid within 30 days of written notice by the Stud Owner. Failure to pay the fee's will result in legal action taken by the Stud Owner in order to procure the fees. 4. the Stud Owner will bear the burden and any cost in accordance with picking up the pick of litter puppy.
The dam owner releases the Stud Owner and its owners/representatives from any and all liability associated with but not limited to the breeding of the dam. The dam owner and anyone accompanying the dam owner waives any and all liability to their persons and physical wellness while on the property
If only one puppy is born (or remaining alive at 8 weeks) the Stud Owner will retain the right to half of the value of the one puppy. The Stud owner will not stipulate the sale value of the puppy, but The Stud owner will aid in the sale of a singleton puppy and forward half of the proceeds to the dam owner if the dam owner has the Stud Owner facilitate the sale.
The stud fee must be paid in full before an attempt for tie/mating is allowed. If for any reason the stud fails to tie the female and the option to collect and manually insert the sperm is not utilitized, the Stud Owner will give the stud fee monies back immediately and before the dam owner leaves the premises.
The dam owner releases the Stud Owner Company and its owners/representatives from any and all liability associated with but not limited to the breeding of the dam and any accident or injury to any person visiting the property. This includes any accident or injury to the dam herself or any persons or animals accompanying the dam for the breeding. The dam owner waives any accident liability to the dam even after leaving the premises where the stud is located.
The Stud Owner may ask for veterinary evidence that the dam did indeed fail to become pregnant on a prior breeding, the burden of cost will lie with the Stud Owner to pay for vet tests. The burden of any cost associated with the delivery and transport of the dam to the veterinary clinic will be by the dam owner. The Veterinary Clinic will be chosen by the Stud Owner and will be within a reasonable distance of the Dam owners residence.
The Dam Owner guarantees that the Dam is healthy, and free of diseases. The Dam Owner guarantees that the Dam has not had any signs of Brucellosis, such as the Dam aborting a litter 5 days prior to a due date, and or any discharge, or multiple failures to produce a litter. The Dam owner guarantees that at the time of mating the Dam has not previously been bred to another male which could also potentially have recently transferred Brucella Canis also known as the Brucellosis. The Dam Owner understands that this disease is uncurable at this time, and any dog testing positive for Brucellosis would be required to euthinized according to Federal Health Regulations pertaining to the disease Brucellosis which is zoonotic and transferrable to people, a gram negative bacteria causing infertility in infected hosts. The Dam Owner understands how serious this disease is to humans, and how devastating a disease it is to a breeding program. Dam Owner Guarantees the bitch not to have brucellosis or any sign of brucellosis.
The dam owner/representative signs this contract and agrees to all the terms laid out in sections 1-10. Dam owner/representative understands that no other agreements are meant or implied and has filled out this form truthfully and to the best of his/her knowledge. The Dam Owner Understands that their IP address of their device being used to fill out this form will be captured, as well as other site use propriety data and gives the Stud Owner permission to use that data and user informatio as the Stud Owner deems fit and necessary.
